1.STATEMENT
OF BOOKING REQUIREMENTS:
1(a)
As required by Department of Employment
regulations Juliet Adams Models and Talent Agency
will operate as an Employment Agency. A booking
confirmation form
containing the terms of the
booking must be signed and returned by the client
prior to the job. A special and/or unique terms
may exist for your assignment.
1(b) CLIENTS
are required to provide full and adequate details
of Work, Assignments, and Castings.
A Juliet Adams booking confirmation form issued
must be signed by the client and returned to the
Agency before artists are released for work and
assignments.
1(c) The
material on this website and in all information
and publicity the agency distributes including
emails and literature may not be published,
broadcast, rewritten, or redistributed in any form
except as may be expressly permitted in writing by
Juliet Adams Modelling & Talent
Agency.
1(d) It
is strictly forbidden to commercially
published, commercially broadcasted, commercially
rewritten or redistributed in any form all forms
are prohibited and it does not exclude any form
types. All Enquires to use image/s materials
and contents commercially should be made in
writing to Juliet Adams Agency, and you must await
written consent. The Agency is the only one who
can provide written permission to use images and
materials commercially.
1(e)
DISCOUNT FEES can be negotiated for selected
advanced orders to use images and materials
commercially.
1(f) Fees/Charges
are payable to the Agency by ALL who use images,
services and materials commercially.
1(g) Substantial
non negotiable charges are payable for unauthorised
uses of the
material on this website and in all information
and publicity the agency distributes including
emails and literature, and where appropriate we shall press for ALL
Legal actions.
BOOKING
FEES
2. Payment of Fees.
2.(a). All fees are to be negotiated with Juliet
Adams Agency and only with the Agency.
2.(b). All payments for fees are to be paid
directly to the Agency. Unless otherwise
contracted in writing.
3. Permitted Use.
In
general, booking fees cover the right to use
one image, photograph, film and/or voice and sound
recordings for one year from the date of the
booking, in the UK only, for the initial Permitted
Use which excludes television and commercial usage
and buyout fees. Tv, commercial and other initial proposed medias, territory's
buyouts
and period of usages of the images and recordings must be
negotiated with the Agency. In perpetuity
negotiations welcome.
4. Session/Daily/Hourly Rate.
Booking fees are charged by the session, day or by the
hour.
5.
Overtime.
Overtime rates apply before 9 am, after 6 pm and
on all bookings over eight hours. .
(a).
The overtime rate is one-and-a-half times the
daily rate between 18.00 and 24.00 hours.
(b). A special rate is negotiated for night work
between 24.00 and 09.00 hours.
(c). Work on Saturdays is at one-and -a-half times
the normal rate.
(d). Work on Sundays and Bank Holidays is at
double the normal rate.
6.
Travel.
Travel will be charged at half the hourly rate:
this applies to travel outside a 5 mile radius of
Hyde Park Corner (i.e. Chiswick in the West,
Golders Green and Highgate Village in the North,
Mile End in the East, Streatham Hill and Tooting
Bec in the South).
7.
Fittings.
Fees for fitting are charged at half the hourly
rate with a minimum of £20 per hour.
8.
Location Bookings.
If a model or performer on location is prevented
from returning to London to work - half the daily
fee is to be paid. (N.B. when a location booking
is made the client must provide information about
transport there and back).
ADDITIONAL FEES
To be agreed at the time of the booking.
9(a). Usage.
Usage
fees are to be negotiated with the agency and must
be stated at the time of the booking. Usage
fees are in addition to the model or performers
session/hourly/daily rate. Billboards, national ads,
consumer product packaging, poster, hang tags,
use of models or performers names, or UK and overseas
television, radio and commercial usage all constitute a
"premium" subject to usage fee
negotiation.
Additional fees
are payable for the right to use images and
recordings i.e
filming and photographs (or variations or reproductions, or adaptations of, or drawings
therefrom, either complete or in part, alone or in
conjunction with any recording wording or drawings) for all
known or anticipated purposes other than the
initial Permitted Use. (e.g. packs, posters,
showcards, record covers, swing tickets etc.) In
general the additional fees cover the right to use
one image or recording product including voice and
sound recordings for one year from the date of the
booking, in the UK only, for the purpose or
purposes agreed.
In perpetuity negotiations welcome.
9(b).
Territory. Additional fees are also payable
for the right to use images voices and sound
recordings filming and photographs (or variations
or
reproductions, or adaptations of, or drawings
therefrom, either complete or in part, alone or in
conjunction with any recording wording or drawings for all
known or anticipated territories other than the
UK. In general the additional fees cover the right
to use one image and/or recording including voice or sound recordings for one year from the date of the
booking. In the territory or territories agreed.
To be agreed after the time of the bookings.
10(a). Usage.
It is the client's responsibility to notify
the agent and negotiate additional fees (including
extensions of existing agreements) for any usage
which may be required or anticipated subsequent to
the time of booking including as per 9(a) above..
10(b).

AGENCY FEES
11(a). All Bookings Except Equity Contract
TV Commercials:
Except
for Equity TV Commercials on repeats. The
Agency reserves the right to charge
clients a service charge on the total of the
quoted shoot, and usage fees on all Child,
model, performers and talent Assignments.
The Agency also charges a further 20% on all travel payments
billed by the agency. Where client opt's not to
pay the artists directly. The agency charges a supplement
on all session, hourly, daily and usage fees. Both agency fees and
model/performers fees will be invoiced by the
agent. Unless otherwise agreed at the time of
booking the model/performers disbursement is
included at 62.5% and the agent's fee at 37.5% of
the quoted
shoot / performance fee
total. An admin charge, VAT and/or any agreed expenses and service
charges will be added. The agency reserves the right to add a
finance
charges on all invoices not paid in full
within 30 days of the invoice, or other contracted
periods, and/or charges for court fees and/or written communications
etc.
11(b).
Equity Contract TV Commercials:
The fee negotiated by the agent is the artist's
fee from which the agency commission will be
deducted at 20% of the invoice total. VAT and/or any agreed expenses
and service charges
will be added.
The agency reserves the right to add a
finance
charges on all invoices not paid in full
within 30 days of the invoice, or other contracted
periods, and/or charges for court fees and/or written communications
etc.
12. Payment Terms.
On all invoices payment is required within 30
days of date of invoice. Unless otherwise stated
in writing. In all cases the company and the
person booking the model will be invoiced jointly
and jointly solely responsible for full payment,
unless otherwise agreed at the time of booking. We
reserve the right to invoice the 'ultimate client'
(i.e. designer/ manufacturer/owner of the product
in question etc) as well as business owners.
All fees are for the right to use pictures and
recordings and once agreed, are payable whether or
not the use is appropriated.
13. Exclusion Fees.
A special fee will be negotiated when the work
is in conjunction with a product which precludes
work for competing products. It is the CLIENT'S
responsibility to check whether conflicting work
has been done. If a model advertises a product
he/she is able to work for any competitor unless
an exclusion fee is negotiated.
PROVISIONAL BOOKINGS for TV,
PRODUCTION FILMING & PHOTOGRAPHIC TRADE
14. Provisional bookings available to
commercial production Filming, TV, Film and
Photographic trade clients will be automatically
cancelled if they are not confirmed within 24
hours of the proposed booking, or if a definite
booking is offered and the provisional cannot be
confirmed.
CANCELLATIONS
15. Unless stated otherwise on contracts if a
booking is cancelled within one working day of the
starting time the full fee will be charged unless
the same model/performer is re-booked within 24
hours in which case half the fee will be charged.
If a booking is cancelled outside the one-day
period but within two working days of the starting
time then half the fee will be charged. Bookings
of more than three days duration: if the booking
is cancelled within a period equal to the length
of the booking, then the full fee is charged.
Saturdays, Sundays and Bank Holidays are excluded
from these calculations. This is a reciprocal
arrangement between model performer and client.
16. Weather permitting bookings.
At
the first cancellation, a half-fee is charged
unless the client fails to cancel in time to
prevent the model's and performers attendance or
reasonable attempted attendance, when the full fee
is payable. At the second cancellation the full
fee is charged.
17. MEALS
Clients are responsible for model's/performers
meals on all booking outside the London area. (See
6.)
FASHION
SHOWS
18. Payment
of the agreed fee confers the right to make use of
a model's and performers services on the catwalk
for the specified show and the right to use
photographs and video of the show for reporting
purposes only. Any other usage must be
negotiated at the time of booking..
VIDEOS
19. All fees will be invoiced to the record
company. For all videos the normal daily rates
will apply PLUS a buy-out to be negotiated.
Insurance
20. The
client is responsible for the models and
performers health and safety when the model is
travelling, or providing services in connection
with the booking to the same extent as if the
model and performer were an employee of the
client. The client will maintain adequate
insurance cover to underwrite its obligations to
the model and performer.
The
agent is not responsible if the model and/or
performer fails to attend the booking. The client
is advised to insure against losses which might
result from the contract including if the model does not keep a booking
because of ill health or some other reason..
Jurisdiction
21. These
terms and conditions for booking and all other
matters connected with the bookings are governed
by English Law and any dispute will be settled in
accordance with that law by a court in England.
CASTINGS, TEST
& EXPERIMENTAL PHOTOGRAPHY
22. The Client, film production and Photographer
is not entitled to use castings, test and
experimental
images, photographs, films and/or voice and sound
recordings for
commercial purposes unless specific arrangements
have been made before the booking session and or
an agreed payment has been received for the right
to do so and/or a non breached contract is in
place confirming agreed rights.
If the Client
is not the filmmakers,
production team and
Photographers the client is to draw these Terms
& Conditions to the attention of the image
takers, photographers and sound
recording people and
obtain his/her agreement to them before the shoot
and performance commences.
Clients are
not entitled to use and grant use of any of the images
and recordings he /she
takes for any usage beyond that agreed and stated
in contracts including
under
sections 3, 9, & 10 above.
MIXED
AGENCY BOOKINGS
23. In the event that model(s) from another agency are
working on the same assignment providing the same services
as model(s) from Juliet Adams Agency but at a higher fee,
the Agency reserves the right to charge at an identical
rate.
LINGERIE
24. Transparent
loungewear, sleepwear, pantyhose, slips, bras,
panties, etc. will be double the hourly rate.
All other lingerie will be billed at time and a
half. Please specify at time of booking.
VOUCHERS/Time
Sheets
25. If
the voucher system/time in time out sheets is used, the client needs to
legibly fill out and sign the voucher/time sheet at the end
of each booking.
OTHER
CLIENT RESPONSIBILITIES
26(a) Disclosure
of extraordinary conditions or requirements.
26(b)
Provide adequate dressing facilities on all
bookings.
26(c)
Give the full, adequate and complete address and phone number of all booking
locations.
26(d)
Confirm
all booking fees prior to actual booking.

Give booker all pertinent billing instructions.
26(f)
It is an integral part of a booking agreement that the
client will provide a copy in reasonable format of the
finished work of the Assignment.
BILLING
PROCEDURE
27. In
order to efficiently bill Juliet Adams Agency
needs the
clients name and address, department #, purchase
order #, job order #, product or project details
and title,
and authorized individual who will approve payment
and be bound by Juliet Adams Agency Terms and
Conditions.
COPYRIGHT
28. The
Photographer and production is not entitled to use
any of the images he /she takes for any usage
beyond that agreed in contracts including under sections 3, 9,
& 10 above. The
